GENERAL CONDITIONS OF SALES

 

Welcome to ChinEAT,

 

these General Conditions of Service have been drawn up in accordance with the provisions of the Consumer Code, Legislative Decree no. 206/2005 and subsequent amendments, and of Legislative Decree no. 70/2003 on information society services and electronic commerce.

 

Please read them carefully and keep a copy.

We also specify that we may make changes or amendments to these General Conditions and other contractual documents at any time. In any case you will find the updated versions of all the documents always published on the site.

The General Conditions and other contractual documents will be automatically and immediately effective, unless otherwise indicated.

The use, registration on the Site, the sending of a purchase order and the use of all the Services offered therein implies full knowledge and express acceptance of these General Conditions, the Conditions of Use of the Website and any other contractual document.

The language available to conclude the contract is Italian, in the event of any translation errors into other languages, what is expressed in the relevant Italian version will prevail.

The applicable law and the competent jurisdiction is the Italian one, without prejudice to the application of mandatory rules for your protection.




DEFINITIONS

In relation to the terms used in this contract, the following must be understood:

 

Platform: the web platform managed by the company DeZhuang Europe s.r.l., which provides an information society service consisting, among others, of offering Users the opportunity to purchase products from the Chinese parent company, imported by DeZhuang Europe s.r.l .;

ChinEAT: the company DeZhuang Europe s.r.l., with registered office in Via Paolo Da Cannobio 9, 20122 Milan, Italy, VAT number: 10898430961, REA MI - 2564823, e-mail office@chineatbrand.com, Pec dezhuangeuropesrl@pec.it ; the legal person that manages the Platform, the domains and subdomains, as well as the owner of the same, of the Services and of the Contents provided through them; the manager and / or owner of the IT infrastructure and not in support of the same;

Consumer: the natural person of legal age who places an order for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out;

Buyer: the natural person of age or legal person who purchases the Goods through the Site;

Seller: the legal person DeZhuang Europe s.r.l .;

Product (s): the goods purchased through the Site;

Price or compensation: the amount of money for the purchase of a product and / or service;

Contract or Contract of sale: the distance agreement concerning the sale of the goods and the Service between the Buyer and the company DeZhuang Europe s.r.l., in the context of an organized electronic commerce service that uses remote communication technology called Internet.

Order: any proposal regarding the purchase of an asset, made by the Buyer to DeZhuang Europe s.r.l .;

Order Confirmation: the e-mail message through which DeZhuang Europe s.r.l. notifies the Buyer of the acceptance of the order;

Promotional code or discount code or coupon: they are personalized codes that allow you to take advantage of a discount exclusively on purchases made online through the Site;

Site: the Platform; the website identified by the domain www. http://www.chineat.shop/it/ and all related subdomains and related domains;

Registered User or User: natural person users who have registered their data on the Platform and who have their own Profile at their disposal, under license;

Profile: the reserved area uniquely attributable in general to a Registered User; the digital environment with customizable content and features, isolated from other users, licensed together with a unique password and username chosen by the Registered User and assigned to the same.



SUBJECT OF THE CONTRACT AND PRE-CONTRACTUAL INFORMATION

This contract relates to the realization and / or distance selling  against payment, of the goods bought and sold by DeZhuang Europe s.r.l .

In compliance with the regulatory provisions of the Consumer Code, Legislative Decree n. 206/2005 and subsequent amendments and the Legislative Decree 70/2003 on electronic commerce, before confirming the sending of the purchase order, DeZhuang Europe s.r.l. provides you, through the individual dedicated web pages, with all the information you have the right to receive on the goods sold.

We inform you that the descriptive images of the products are merely illustrative, as they may not be perfectly representative of their real characteristics, but differ, for example, in color and / or size, and yet the seller adopts every possible technological solution to minimize inaccuracies.



PURCHASE PROCEDURE AND CONCLUSION OF THE CONTRACT

In order to purchase the goods we will ask you to:

  • create a profile by registering or you can proceed with the purchase as a guest;

  • select the chosen product (s) and add it (s) to the cart. You can choose to purchase one or more Goods at the same time;

  • view the summary of the selected products in the cart page;

  • enter all mandatory data in compliance with the conditions of use;

  • approve these general conditions;

  • give your consent to the processing of personal data.

 

Having entered your data, selected the payment method, any additional conditions such as, for example, the use of promotional codes where possessed and the shipping methods, you can proceed, using the "CONFIRM ORDER AND PAY" button, to '' sending to DeZhuang Europe s.r.l. the purchase order of the selected products and payment.



Once the payment has been made, DeZhuang Europe s.r.l. will send you an ORDER RECEIPT CONFIRMATION via email including the following content:

  • the order number;

  • information and images of each product and its price, including shipping costs;

  • payment method used;

  • recipient and place of dispatch of the goods;

  • billing information;

  • the methods of delivery of the purchased product and the relative shipping and delivery costs;

  • a reference to these General Terms and Conditions;

  • a reference to the conditions for exercising the right of withdrawal;

  • the contact details of DeZhuang Europe s.r.l .;



Once your order has been processed, DeZhuang Europe s.r.l. will send you an ORDER CONFIRMATION e-mail with the following info:

  • the order number;

  • the price of the product (s) purchased, including shipping costs;

  • the recipient and the delivery address to which the product will be sent;

  • billing information;

  • the link to exercise the right of withdrawal, if entitled;

  • link to be able to print and archive the copy of these conditions;

  • the contact details of DeZhuang Europe s.r.l.



The contract will be considered concluded only when we send you the ORDER CONFIRMATION e-mail.

If you do not receive the order receipt email within the deadline of no. 10 working days from the sending of the order, this must be considered rejected by DeZhuang Europe s.r.l.

Please notify us promptly of any necessary corrections to your personal data or your orders at office@chineatbrand.com



FULFILLMENT, NON-ACCEPTANCE AND CANCELLATION OF THE ORDER

DeZhuang Europe s.r.l. undertakes to deliver, by means of a carrier chosen by you, the goods you have ordered within 15 days from the date of conclusion of the contract.

DeZhuang Europe s.r.l. may in any case not accept or cancel the order placed in the following cases:

  1. the order is incomplete or incorrect;

  2. the billing information and data provided by the user are incorrect, incomplete or not verifiable;

  3. the product and / or service is not available or is out of stock. In this case DeZhuang Europe s.r.l. 

  4. undertakes to notify you within 10 working days from the day following that in which the order was received, any unavailability of the products and / or services ordered;

  5. the payment has not been received or is incomplete;

  6. in the event of an error in the declared price;

  7. in case of impossibility to make the delivery to the address provided by the user;

  8. in case of errors in the texts, in the price list or other errors or inaccuracies in the information reported on the e-commerce;

  9. in the event that it is in progress between the consumer and DeZhuang Europe s.r.l. a legal dispute relating to a previous order, in the event of previous violations of the contract conditions for the purchase on e-commerce or violation of the conditions of use of the site.

In all these cases, DeZhuang Europe s.r.l. will notify you by e-mail, explaining the reasons why the order was not carried out. In the event that payments have been made, these will be reimbursed within 15 days of the notification of non-acceptance or cancellation of the order.



PRICES

The prices for the purchase of the Goods indicated by DeZhuang Europe s.r.l. both on the Site and in the purchase order include VAT. In any case, the only valid price will be that indicated at the time the order is sent.



PROMOTIONAL CODES

DeZhuang Europe s.r.l. may issue, on its sole will and initiative, promotional codes, on the occasion of specific circumstances (promotional offers, advertising campaigns, etc.) or particular initiatives (eg. shopping points collection).

The duration, validity, value and / or any specific conditions for the use of promotional codes will be specified from time to time by DeZhuang Europe s.r.l. in the voucher that contains them or through separate communication via email.

The discount code can only be used by its recipient, who is the exclusive owner. This code is therefore not transferable to third parties.

If you intend to use the discount code, you will need to enter the promotional code during the purchase procedure in the corresponding box.

Should you encounter any difficulties, you can contact our assistance service before proceeding with the payment.

If the value of the Discount Code is lower than the value of the order, the difference must be integrated with the payment methods provided on the Site, if, however, the remaining sum is higher, it will be considered lost.

We inform you that once the payment has been made, it will no longer be possible to use any discount code in possession for that specific order.

Each discount code must be spent in a single solution and can only be used for orders subsequent to its issue.

Only one promotional code can be used for each order.

The discount code cannot in any way be converted into cash.

Unless otherwise expressly provided by DeZhuang Europe s.r.l., the discount code cannot be applied to items already subject to promotions and / or special offers.

In case of exercising the right of withdrawal (or cancellation of the order), once the return has been accepted, the relevant code cannot be reactivated. The difference in expense (original value of the asset net of the discount applied) that you have incurred for the purchase of the item will be re-credited to you in accordance with the terms and conditions set forth for the normal refund procedure.



TERMS OF PAYMENT

The payment of the price of the Goods, the relative shipping and delivery costs can be made through the payment service manager chosen by you, among those indicated on the order page: at the time of sending the order, the browsing session can be transferred to the site of the payment service provider, to which you will then have to provide the data required for the payment that will be managed directly by the same. For any information on the processing of your data, we invite you to consult the privacy policy of the manager you have chosen.

At no time during the payment procedure DeZhuang Europe s.r.l. will be able to know your payment details. This information will in fact be transmitted directly to the person who manages the electronic payment through a protected and encrypted connection. Therefore, DeZhuang Europe s.r.l. cannot in any way be held responsible for any fraudulent and undue use of data by third parties.




SHIPPING AND DELIVERY

The order will be delivered to you in the place you indicated together with the order receipt  and any material of commercial nature.

The shipping costs, including those of any storage, have to be considered at your expense and will vary according to the place of destination and the type of shipment, as you will see on the order confirmation page in which you are given the opportunity to choose the type of shipment which suits you the most. In any case, these costs will be quantified before you send the order confirmation.

In case you communicate an incorrect shipping address of the goods, the costs of any new shipment requested (including those of any storage cost), will also be at your expense.

DeZhuang Europe s.r.l. is not required to ship the products until it has received the payment of the extra fees related to the aforementioned situations (wrong shipping address and storage costs).

 

Once the payment is received, DeZhuang Europe s.r.l. will send the products within 10 working days starting from:

- the receipt of the communication of the bank debit authorization from the bank, in case of payment by credit card;

- the receipt of communication of any other debit authorization in case of payment by means other than credit card.

In case the products available at the time of the conclusion of the contract have subsequently become unavailable, DeZhuang Europe s.r.l. will, if possible, send them no later than 30 working days from the time the product is made available again. In case of unavailability of the product DeZhuang Europe Srl will refund the amount received.

DeZhuang Europe s.r.l. undertakes to do everything in its power to ensure that the products shipped are delivered by the selected couriers within 7 working days of delivery to the carrier if the shipment is made to the Italian territory. However, DeZhuang Europe s.r.l. cannot be held responsible for any problems that may arise related to delivery.

 

The shipment will be communicated to you by sending a specific e-mail.

We invite you, upon receipt of the products, to check that: a) the packages delivered correspond to those ordered, b) the integrity of the packaging and the product.

If you notice the presence of any damage to the packaging or if the number of packages does not correspond to those ordered or there are different indications, remember to immediately contest them in the following ways, different depending on the problem that arose:

  • in case of slight damage to the packaging or mismatch of packages or indications: accept the goods by adding the words "ACCEPTANCE WITH RESERVE" and specify in writing the reason for the reservation, indicating on the proof of delivery that the courier will make you sign the following terms: "it is accepted subject to control due to evident damage to the packaging" or "it is accepted with reserve, package 1 of 2 is missing".

  • in the event that you detect the presence of important deformations, do not accept the delivery and have the courier note the deformation detected.

 

We invite you to pay attention to the aspects indicated above since, once the courier's document has been signed, you will no longer be able to make any objection about the external characteristics of what was delivered!

As for the contents of the packages delivered, we inform you that any discrepancies and / or problems relating to the physical integrity or completeness of the products received must be reported within the day following the delivery, in the manner provided for in this document.

In case of non-collection within 5 working days of the material in stock at the courier's warehouses due to repeated inability to deliver to the address indicated in the order, the order will be returned to DeZhuang Europe s.r.l. who will refund the amount paid by debiting and deducting the shipping and storage costs from the refund amount, as applied by the courier.

DeZhuang Europe s.r.l. is responsible for the goods purchased up to the time of shipment, that is, until the goods pass into the possession of the courier: from that moment on, the courier will be responsible for what is entrusted to him and any claim will therefore be made to the courier himself.

Therefore, in case of purchase of fragile products (such as bottles of oils or jars of pepper, etc.) we recommend that you purchase the shipping insurance service which with a minimum additional cost will cover any problem due to transport.



CONSUMER LEGAL GUARANTEE

If you are a Consumer We remind you that you have the right to the legal guarantee of conformity, i.e. to receive goods that comply with the sales contract and that in the event of the purchase of products that are not suitable for their purpose or that do not respond to the use declared by DeZhuang Europe s.r.l., you will have right to the replacement of the goods by DeZhuang Europe s.r.l. as a seller, free of charge.

If the replacement is not possible, you will still have the right to a reduction in the price or a refund of the amount paid, against the return of the defective product to DeZhuang Europe s.r.l.

Remember that this legal guarantee lasts two years from when the goods were delivered to you and that it must be asserted within two months from the discovery of the defect: We suggest that you always keep the proof of purchase.





CONSUMER RIGHT OF WITHDRAWAL

If you are a Consumer and you have purchased a good that is not included among those for which the right of withdrawal is excluded by the law (i.e. goods that are likely to deteriorate or expire rapidly and sealed goods that do not lend themselves to being returned for hygienic or related reasons protection of health that were opened after delivery), you will have the right to withdraw from the contract concluded with DeZhuang Europe s.r.l., without any penalty and without specifying the reason, communicating your intention to withdraw to DeZhuang Europe s.r.l., within the deadline of fourteen (14) days, starting from the day on which you received the order confirmation email.

 

In order to exercise the right of withdrawal you will need to provide us with an explicit declaration,  by email to office@chineatbrand.com, in which it will be sufficient to enter: your personal data, those relating to the order and the purchase made , the intention to withdraw from the contract with the request to return the price paid within the term of 14 days.

Alternatively it will be possible to use the following formula:

hereby the undersigned _________________________ (insert name and surname of the consumer who concluded the contract), by sending this form I notify the withdrawal from the sales contract of the following goods (________________), ordered on ______________ ( insert date of conclusion of the contract) and confirmed on ______________________ (insert date of receipt of the order confirmation communication).

I request the reimbursement of all payments made by me, equal to Euro _____________________ (insert amount paid) by means of ___________________________ (insert payment method used to pay the price).

DeZhuang Europe s.r.l., will reimburse you the sums paid no later than 14 days from the day on which it receives the notice of withdrawal. For the refund, the same payment instrument you used for the purchase will be used, unless agreed in writing by both parties.

Exercising the right of withdrawal entails the duty to return the order, in all parts and in its entirety, as it is not possible to exercise withdrawal only on part of the purchased product.

We inform you that in case of withdrawal all shipping costs and additional charges will be at your expense.



Exclusion of the right of withdrawal

Attention: If you are a Consumer and you have purchased a good falling within those listed below, you will not have the right to withdraw according to the provisions of art. 59 of Legislative Decree. 205/2006.

The right of withdrawal for distance contracts and contracts negotiated away from business premises is in fact excluded in relation to:

  1. the supply of goods which are liable to deteriorate or expire rapidly;

  2. the supply of sealed goods which cannot be returned for hygienic reasons or related to health protection and have been opened after delivery.



JURISDICTION

If you are a Consumer, any disputes may be resolved by the Court of the place where you have your domicile or residence, or by the Court of Milan.

The applicable law and the competent jurisdiction is the Italian one, without prejudice to the application of mandatory rules for your protection.
